DIAMOND DASH 2019 OFFICIAL CONTEST RULES

ELIGIBILITY.

The Diamond Dash (“Game”) is open to individuals that:

(a) possess a mobile device that utilizes the Apple iOS operating system or the Google Android operating system (each a “Mobile Device”) and supports the free GooseChase application made available to the public in the iTunes Store and the Android Market;

(b) are registered users of GooseChase (“Registered Users”);

(c) actively play and/or participate in the Game through GooseChase and

(d) reside within Wisconsin, Iowa or Minnesota and who are at least 21 years of age or older as of the date of entry into the Game.

Game not open to employees or immediate family members (spouses, parents, siblings and children) of employees of the Sponsoring Entities, as defined herein. Void where prohibited, or otherwise restricted, by law. All federal, state and local laws and regulations apply. Winners must sign an affidavit of eligibility and liability/publicity release or prize will be forfeited.

All content (including photos) submitted to the Diamond Dash by participants as part of the Game becomes property of Mid-West Family La Crosse and Mark Jewellers.

Mid-West Family La Crosse and Mark Jewellers and their respective parents, subsidiaries, affiliates, directors, officers, governors, owners, employees, and agents (all collectively, the “Sponsoring Entities”) will not be responsible for lost, misdirected, late, postage due, incomplete, illegible or unintelligible entries or for inaccurate entry information whether caused by participant or by any of the equipment or programming associated with or utilized in this Game, or by any technical or human error that may occur in the processing of entries or claims for points. Mechanically reproduced or automated entries are not permitted and will be deemed void. By submitting an entry or accepting a prize, participants accept and agree to be bound by these rules and the decisions of Mid-West Family La Crosse and Mark Jewellers, which shall be final on all matters.

REGISTRATION PERIOD. The Diamond Dash registration period begins at 12:00 a.m. CST on August 16th 2019 and ends at 11:30a.m. CST on September 21st, 2019 (the “Registration Period”).

HOW TO REGISTER. In order to qualify for the Diamond Dash you must register online at z933.com or in person at the Diamond Dash on Saturday, September 21st. (1) entry per (team) in the Game.

HOW TO PLAY. Once you’re an approved Diamond Dash participant (team), you must become a registered user of the GooseChase application, complete missions listed in the Game software. Successful completion of missions (as determined by Mid-West Family La Crosse in it’s sole discretion) shall receive points. Missions shall only be available between September 21st 2019 at 12pm Central Daylight Time through September, 21st 2019 at 1:30pm Central Daylight Time (the “Contest Period”) (all mission completion times to be determined by Mid-West Family La Crosse in their reasonable discretion).

PRIZES. At the end of the Contest Period, the participant (team) with the most points shall receive a diamond ring valued at $5,000 from Mark Jewellers. A second winner (team) will be randomly selected through a random drawing of all eligible teams. The random drawing winner will also receive a $5,000 ring from Mark Jewellers. Winners are solely responsible for all applicable federal, state and local taxes and any expenses associated with any prizes. In the event a winner cannot does not respond declines the prize, another winner will be selected.

Ties in point totals for prizes shall be won by the team who completed the largest number of challenges during the Game. If this does not serve to break the tie, the tie shall be broken in a bonus mission (from among those tied) conducted by Mid-West Family La Crosse at the end of the Contest Period.

ODDS OF WINNING. Odds of winning are dependent on the number of eligible entries received. There will be a total of one (2) winner chosen.

ASSIGNMENT OF RIGHTS. Entrants and winners agree that the Sponsoring Entities and their designees may use their entry, entrant’s name, voice, city/state of residence, photograph and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification. Entrants and winners further grant the Sponsoring Entities a royalty-free, world-wide, perpetual, non-exclusive license to display, distribute, reproduce, and create derivative works of the entries, in whole or in part, in any media now existing or subsequently developed, for any purpose, including, but not limited to advertising and promotion. The Sponsoring Entities will not be required to pay any additional consideration or seek any additional approval in connection with any use of any portion of any entry. By entering or accepting a prize, entrants and winners warrant that they have the rights to use (and assign to the Sponsoring Entities the above rights to use) any materials submitted as part of their entry or entries, agree to grant and agree to hold the Sponsoring Entities harmless for any liability, loss, injury, or damage to property or to person (all, collectively, “Losses”), including claims of infringement, misappropriation, or other misuse or alleged misuse of the intellectual property rights, rights of privacy, or rights of publicity of a third party by the Sponsoring Entities, due in whole or in part, directly or indirectly, to any use by Sponsors or their designees of any portion of a particular entry, even if such Losses were caused or contributed to by the negligence of the Sponsoring Entities. By entering or accepting a prize, entrants or winners also acknowledge that Mid-West Family Broadcasting may edit entrants’ submissions in any way Mid-West Family La Crosse deems fit on an as needed basis.

MISCELLANEOUS RELEASE. By entering or accepting a prize, participants agree to be bound by these rules. In addition, all entrants and winners agree that Mid-West Family La Crosse maintains the right to decide all matters and disputes arising from the Game, and that Mid-West Family La Crosse’s determination of the winners will be final and binding. No transfer, assignment, cash redemption or substitution of any prize is permitted, except by Sponsors due to prize availability and then with a prize of equal or greater value. By entering or participating in the Game, participants agree that the Sponsoring Entities will have no liability and will be held harmless by winners for any liability, loss, injury, or damage to property or to person, including death, due in whole or in part, directly or indirectly, by reason of the acceptance, participation in, use or misuse of the prizes, or by reason of participation in the Game, even if caused or contributed to by the negligence of sponsors.

ADDITIONAL TERMS. The Sponsoring Entities reserve the right, in their sole discretion, to modify, terminate, or suspend this Game should viruses, bugs, unauthorized human intervention or other causes beyond Sponsors’ control corrupt or impair the administration, security or fairness of the Game. The Sponsoring Entities are not responsible for any human error that may occur in the processing of the Game or any individual submission for points credit, nor are they responsible for any error, omission, interruption, deletion, defect, communications line failure, theft or destruction of, unauthorized access to, delay in operation, transmission, or distribution of, or alteration of, mission locations, entries, submissions for points credit, whether caused by the sender, any of the equipment or programming associated with or utilized in this Game, or otherwise. Sponsoring Entities reserve the right, in their sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Game; to be acting in violation of these rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar entry methods will void all such entries submitted by such methods. In the event of a dispute as to entries submitted by multiple users having the same e-mail or telephone account, the authorized subscriber of the e-mail account used to register for the Game at the actual time of the entry will be deemed to be the participant and must comply with these rules. The authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail addresses.

E-MAIL CHANGE OF ADDRESS POLICY. It is the sole responsibility of the entrant to notify Mid-West Family La Crosse if his or her e-mail address or phone number changes.

DISPUTE/CHOICE OF LAW. To the extent these rules conflict with any general Mid-West Family Broadcasting rules, these rules shall control. All decisions of the Sponsoring Entities with regard to this Game are final. Except where prohibited, each entrant and winner accepting a prize agrees that: (i) all issues and questions concerning these rules shall be governed by Wisconsin law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Game or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state courts situated in Wisconsin, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
